Who cannot be dismissed?

In Poland, some groups of employees are protected from the termination of an employment contract made by an employer.

Your employer cannot dismiss you if you are:

  • not more than four years before reaching the age of retirement, provided that the period of work for that particular employer would render him/her eligible for a pension on reaching this age;
  • during your holiday leave or other justified absence from work (e.g. when you are on a sick leave);
  • pregnant, on a maternity leave or during a childcare leave.

Remember!

If you fulfill at least one of the above conditions, your employer cannot dismiss you, unless the company declares bankruptcy or goes into liquidation. However, the employer may terminate the contract upon the employee’s fault without the notice period.
